The extintive procedure of eco-offences: problematic application’s field, desired changes and dashed hopes of the cartabia reform

Abstract. In questi primi anni di vigenza, la procedura estintiva ambientale ha proficuamente contribuito a ridurre l’area applicativa degli eco-reati, ma, al contempo, ha manifestato alcune incertezze interpretative, soprattutto in relazione al suo raggio di operatività. Tuttavia, il recentissimo d. lgs. n. 150/2022, pur avendo avuto l’occasione di risolverle grazie ad una delega molto elastica sul punto, le ha amplificate. Invece di procedere ad un riordino della disciplina delle diverse ipotesi estintive disseminate nel sistema penale, tra cui quelle ambientali, eliminando le più evidenti asimmetrie, ha introdotto una nuova ipotesi premiale speciale per le contravvenzioni alimentari le cui peculiarità disciplinari fanno apparire alcune scelte legislative in materia di eco-contravvenzioni irragionevoli.
Abstract. In its first few years in force, the environmental extinction procedure has successfully contributed to reducing the application area of eco-offences, but, at the same time, it has manifested some interpretative uncertainties, especially in relation to its range of applicability. However, the very recent Legislative Decree no. 150/2022, although having had the opportunity to resolve them thanks to a very elastic delegation on this point, has increased them. Instead of reorganizing the discipline of the various extinction hypotheses scattered throughout the penal system, including the environmental ones, eliminating the most obvious asymmetries, it has introduced a new special reward hypothesis for food-related offences whose disciplinary peculiarities make certain legislative choices in the field of eco-crimes appear unreasonable.
